SEWB Platform – Terms of Service

  1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the SEWB mobile application, website, and related digital health services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

In these Terms, “SEWB”, “we”, “us”, or “our” refers to SEWB Pty Ltd.

  1. Nature of the Platform

SEWB provides a digital health and wellness support platform that includes:

  • Wellness Trends: AI-driven insights based on your health profile and data inputs
  • Health Professional (HP) Matchmaking: Matching users with suitable health professionals based on needs and preferences

SEWB does not provide medical advice, diagnosis, or treatment. The Platform is intended for informational and support purposes only.

You should always seek advice from a qualified healthcare professional before making medical decisions.

  1. Eligibility and Account Registration

To use the Platform, you must:

  • Be at least 18 years of age or have appropriate parental/guardian consent
  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your account credentials

You are responsible for all activities conducted under your account.

  1. Data Collection and Use

By using the Platform, you consent to the collection, use, and disclosure of your personal and health information as described in our Privacy Policy.

This may include:

  • Health and wellness data you provide
  • Data collected via integrations (e.g., wearable devices and third-party APIs)

We use this information to:

  • Deliver and improve Platform services
  • Generate personalised insights
  • Facilitate matching with health professionals
 
  1. Privacy and Legal Compliance

SEWB complies with applicable Australian laws and standards, including:

  • Privacy Act 1988 (Cth)
  • Australian Privacy Principles (APPs)
  • Aged Care Act 1997 (Cth) (where applicable)

We may use de-identified or anonymised data for analytics and AI model improvement. No personally identifiable information (e.g., name, Medicare number, address) is shared with third-party AI providers without your consent.

  1. Data Security

We implement reasonable technical and organisational measures to protect your information, including encryption and access controls.

However, you acknowledge that:

  • No system is completely secure
  • You use the Platform at your own risk
 
  1. AI and Information Disclaimer

The Platform uses artificial intelligence and data analytics to generate insights.

You acknowledge that:

  • Outputs may not always be accurate, complete, or current
  • AI-generated insights are not medical advice
  • SEWB does not guarantee clinical accuracy

To the extent permitted by law, SEWB disclaims liability for reliance on such outputs.

  1. Health Professional Services

SEWB facilitates connections between users and independent health professionals.

  • Health professionals are independent practitioners, not employees or agents of SEWB
  • SEWB does not guarantee availability, suitability, or quality of care
  • Any treatment or advice is solely the responsibility of the health professional
 
  1. Third-Party Services

The Platform may integrate with third-party services (e.g., wearable providers).

You acknowledge that:

  • These services are governed by their own terms and privacy policies
  • SEWB is not responsible for third-party data accuracy, availability, or security
 
  1. Fees, Charges, and Commission
  • SEWB will charge users a commission (currently 10%) on health professional appointment fees.
  • Additional peak charges may apply during specified times (e.g., weekends or evenings)
  • Goods and Services Tax (GST) will be applied in accordance with Australian law
  • By using the SEWB platform and booking any service, you authorize SEWB to automatically charge and/or deduct the applicable fees, including appointment charges, service fees, taxes, and any other applicable costs, from your selected payment method. Such charges may be processed at the time of booking, upon confirmation, or after completion of the service, as applicable. You agree to maintain valid and sufficient payment details to enable successful transactions.

All fees are subject to change. Updates will be communicated via the Platform.

  1. Subscription Plans

SEWB offers the following subscription plans:

  • Starter Plan – Free access to basic features
  • Premium Plan – Paid access to enhanced features
  • Family Plan – Paid plan allowing one user (“Organiser”) to add up to five (5) additional members

For Family Plans:

  • The Organiser is responsible for managing member access
  • You must have appropriate consent to input or manage another person’s health data
 
  1. User Obligations

You agree not to:

  • Use the Platform for unlawful or harmful purposes
  • Interfere with or disrupt the Platform
  • Attempt to reverse-engineer or exploit the Platform

We may suspend or terminate your access if you breach these Terms.

  1. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided on an “as is” and “as available” basis
  • SEWB excludes all warranties not expressly stated
  • SEWB is not liable for any indirect, incidental, or consequential loss

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

  1. Termination and Data Deletion

You may stop using the Platform at any time.

You may delete the account from the app anytime you wish.

Upon deletion:

  • Personal data will be removed or de-identified
  • Some information may be retained where required by law
 
  1. Changes to These Terms

We may update these Terms from time to time.

  • Updated Terms will be published on the Platform
  • Continued use constitutes acceptance of the updated Terms
 
  1. Governing Law

These Terms are governed by the laws of Australia.

Any disputes will be subject to the jurisdiction of Australian courts.
